Esta práctica constituye una vulneración de derechos fundamentales como derecho al trabajo, la dignidad humana, la intimidad y el honor personal.

Como coordinador legal del Observatorio de Derechos Humanos para Grupos Vulnerabilizados –ODHGV-, me preocupa profundamente que estas pruebas sean utilizadas como una herramienta discriminatoria contra ciertos grupos de la población. Las personas que viven con VIH tienen derecho a trabajar en igualdad de condiciones, sin ser discriminadas por su estado de salud. Del mismo modo, las personas que son usuarios de drogas, mujeres embarazadas, hepatitis, entre otras no deben ser excluidas del mercado laboral.

Las pruebas de laboratorio preempleo son una clara violación de los derechos humanos fundamentales. Estas pruebas no deberían ser utilizadas como una herramienta para discriminar a las personas por su estado de salud o por su condición de usuario de drogas. La salud es un derecho fundamental y no debe ser motivo para privar a alguien de su derecho al trabajo.

Cuando leemos el artículo 62 de la Constitución Dominicana, que versa sobre el derecho al trabajo, expresa que éste es un derecho, un deber y una función
social que se ejerce con la protección y asistencia del Estado. Y que es finalidad esencial del Estado fomentar el empleo digno y remunerado. Y continuando en ese mismo artículo en sus numerales 3 y 5, expresan lo siguiente: 3) Son derechos básicos de trabajadores y trabajadoras, entre otros: la libertad sindical, la seguridad social, la negociación colectiva, la capacitación
profesional, el respeto a su capacidad física e intelectual, a su intimidad y a su
dignidad personal. 5) Se prohíbe toda clase de discriminación para acceder al empleo o durante la prestación del servicio, salvo las excepciones previstas por la ley con fines de
proteger al trabajador o trabajadora.

Además, estas pruebas también violan la intimidad y el honor personal de las personas. El hecho de que se les obligue a revelar información sobre su estado de salud y su conducta personal que dista de lo profesional es injusto y estigmatizante. Esto no solo es discriminatorio, sino que también puede tener consecuencias graves para la salud mental y emocional de las personas.

Del mismo modo, cabe hacer un alto y reflexionar sobre el escenario que se le brinda al usuario de drogas en relación al pleno de desarrollo de su vida, no se quiere que tengan conductas amorales y que tiendan a delinquir, pero se les niega el acceso a conseguir un trabajo digno; garantizándoles una muerte en vida a nivel laboral.

Como coordinador legal del Observatorio, hago un llamado a las autoridades competentes para que tomen medidas inmediatas para detener esta práctica discriminatoria y garantizar que las pruebas de laboratorio preempleo sean respetuosas de los derechos humanos y la dignidad de las personas. Es responsabilidad del Estado garantizar que las políticas y prácticas laborales sean inclusivas y respetuosas de los derechos humanos fundamentales.

En conclusión, las pruebas de laboratorio preempleo en nuestro país deben ser revisadas y reformadas para garantizar que no se utilicen como una herramienta discriminatoria contra ciertos grupos de la población. Las personas que viven con VIH, y usuarios de drogas, embarazadas, hepatitis, entre otras, tienen derecho a trabajar y a ser tratadas con dignidad y respeto. Es nuestro deber como sociedad garantizar y velar que estos derechos sean protegidos y respetados.
